1. Acceptance of Terms

By accessing or using the Part-Time Nanny mobile application or website ("Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

2. About Part-Time Nanny

Part-Time Nanny is a marketplace platform that connects Families with independent Nannies for part-time and seasonal childcare services. Part-Time Nanny is not an employer of Nannies and does not provide childcare services directly.

3. Eligibility

• Be at least 18 years of age
• Be a legal resident of the United States
• Have a valid phone number for account verification
• Provide accurate and truthful information during registration
• Not have been previously banned or suspended from the Platform

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, notifying us immediately of any unauthorized use, and keeping your profile information accurate and up to date.

5. Nanny Verification

5.1 Standard Verification

• Government-issued ID upload
• Sex offender registry check via Family Watchdog
• Minimum of 2 professional references (contacted by our team)
• Required attestation that the Nanny is legally authorized to provide the services they offer through Part Time Nanny and will maintain any authorization, licenses, permits, or other documentation required by applicable law (date and time of agreement are recorded)

5.2 A-Team Verification

Nannies may optionally purchase A-Team Verification ($59.99) which includes a comprehensive criminal background check through Checkr. A-Team Verified Nannies receive priority placement in search results and a verified badge on their profile.

5.3 Verification Limitations

While we take verification seriously, Part-Time Nanny cannot guarantee the accuracy of background check results or the conduct of any Nanny. Families should exercise independent judgment when hiring.

6. Payments and Fees

6.1 Family Subscriptions

Families can use Part-Time Nanny on Free, or subscribe for recurring nanny care, lower fees, messaging and video chat for ongoing care, paid trial-day booking, Emergency/Backup Care at member rates, priority matching, and daily or weekly 1-click payments with clock in / clock out.

• Free: $0/month — One-Time Care has a 10% PTN Service Fee (minimum $6.99, maximum $30); Emergency/Backup Care has a 10% PTN Service Fee plus a $9.99 Emergency/Backup Care Fee; new Recurring Nanny Care is not available; clock in / clock out and 1-click payments remain enabled; daily/weekly pay schedules and priority matching require a paid plan
• PTN+: $19.99/month — One-Time and Recurring Nanny Care have a 5.5% + $0.50 PTN Service Fee; Emergency/Backup Care has the same PTN Service Fee plus a $4.99 Emergency/Backup Care Fee; priority matching; messaging and video chat for ongoing care; paid trial-day booking; daily or weekly 1-click payments with clock in / clock out
• The Mother Lode: $199.00/year — every PTN+ member feature; the long-term money saver at $40.88/year less than PTN+; One-Time and Recurring Nanny Care have a 4.5% + $0.50 PTN Service Fee; Emergency/Backup Care has the same PTN Service Fee plus a $2.99 Emergency/Backup Care Fee

Existing active Free recurring bookings may finish at their prior 6.5% + $0.50 PTN Service Fee. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Emergency/Backup Care is not guaranteed to have a sitter available at all times.

6.2 Booking Deposits

All bookings require a deposit equal to the Nanny's hourly rate multiplied by the hours on the first day (or first week for weekly pay). This deposit is held at booking confirmation and released to the Nanny after hours are confirmed.

6.3 In-App Payment Fees

PTN Service Fee — “We handle booking, payments, timekeeping, and care support.” For One-Time Care, Free pays 10% with a $6.99 minimum and $30 maximum, PTN+ pays 5.5% + $0.50, and The Mother Lode pays 4.5% + $0.50. For Recurring Nanny Care, PTN+ pays 5.5% + $0.50 and The Mother Lode pays 4.5% + $0.50; new recurring bookings are not available on Free. For Emergency/Backup Care, Free pays 10% (no min/max) plus a $9.99 Emergency/Backup Care Fee, PTN+ pays 5.5% + $0.50 plus $4.99, and The Mother Lode pays 4.5% + $0.50 plus $2.99.

Emergency/Backup Care Fee — “We helped you solve an urgent childcare problem.” Added to on-demand / within-24-hour care at $9.99 on Free, $4.99 on PTN+, and $2.99 on The Mother Lode.

Listed PTN fees include card payment processing. Families are not charged a separate Stripe processing fee on top of the PTN Service Fee or Emergency/Backup Care Fee.

6.4 Nanny Payouts

• Standard payout: Free, 1-3 business days
• Same-day payout: 1% fee, arrives same business day

6.5 In-App Payments Only

All payments for care arranged through Part-Time Nanny must be processed through the Platform (including deposits and payments tied to clock in / clock out hours confirmation). Families and Nannies may not arrange cash, Venmo, Zelle, or other off-platform payments for Platform bookings. Circumventing the Platform payment system is a violation of these Terms and may result in suspension or termination.

7. Cancellation Policy

• 72+ hours before start: Full refund of deposit
• 48 hours before start: 75% refund of deposit
• 24 hours before start: 50% refund of deposit
• 12 hours before start: No refund — Nanny is paid in full

8. User Conduct

All users agree not to provide false information, use the Platform unlawfully, harass other users, circumvent our payment system, share login credentials, post inappropriate content, or use the Platform to recruit Nannies away from the platform.

9. Independent Contractor Relationship

Nannies are independent contractors, not employees of Part-Time Nanny. Nannies are responsible for their own taxes and insurance. Part-Time Nanny does not withhold taxes from Nanny earnings.

10. Disputes Between Users

Part-Time Nanny may, at its discretion, facilitate resolution of disputes between Families and Nannies related to bookings and payments processed through the Platform.

11. Suspension and Termination

Part-Time Nanny reserves the right to suspend or terminate any account that violates these Terms, receives multiple complaints, is flagged on a sex offender registry or background check, engages in fraudulent activity, or provides false information during verification.

12. Limitation of Liability

To the fullest extent permitted by law, Part-Time Nanny shall not be liable for the conduct of any Nanny or Family, any injury or damage arising from childcare services, any disputes between users, any inaccuracies in background check results, or any technical failures. Our total liability shall not exceed the amount you paid to us in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Part-Time Nanny, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or your violation of these Terms.

14. Intellectual Property

All content, features, and functionality of the Platform are the exclusive property of Part-Time Nanny and are protected by copyright and other intellectual property laws.

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or by email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.
